Terms & Conditions – Fynd Vintage
Article 1 – Seller identification
This website is operated by Fynd Vintage, with registered office at Rue de Mèves 28, 1325 Corroy-le-Grand, Belgium. VAT number: BE0742995155. Email: hello@fyndvintage.com. Phone: +32 498 82 73 20. (hereinafter "Fynd Vintage", "we", "us").
Article 2 – Purpose
These General Terms and Conditions of Sale (the "Terms") govern the sale of second-hand products, vintage furniture and decorative items by Fynd Vintage, to consumers and professional buyers. By confirming an order, the customer accepts these Terms in full and without reservation. The version applicable is the one in force on the date of the order.
Article 3 – Prices and VAT margin scheme (Belgium)
– Prices are shown in Euros, all taxes included, excluding shipping costs.
– Margin scheme: in accordance with Article 58 of the Belgian VAT Code (Directive 2006/112/EC), Fynd Vintage operates under the special margin scheme for second-hand goods. VAT is therefore not deductible by the buyer. Invoices bear the mention "Special scheme – Second-hand goods".
– Shipping costs are calculated at checkout based on weight, volume and destination, and displayed before payment.
Article 4 – Orders and payment
– Any order implies full acceptance of these Terms. The sales contract is concluded once Fynd Vintage confirms the order by email.
– Payment is due immediately upon ordering. Accepted methods: credit card (Stripe), bank transfer, PayPal.
– Fynd Vintage may refuse or cancel an order for a legitimate reason (existing dispute, stock error, suspicion of fraud). Any amount already paid is then refunded.
Article 5 – Condition of goods (vintage specificity)
Items are second-hand goods. Due to their age and nature, they may show signs of use, scratches, fading or patina. These characteristics are not defects but part of the character and history of vintage furniture. Each item is described and photographed as accurately as possible; the customer acknowledges having reviewed the condition before ordering. This is without prejudice to the legal guarantee referred to in Article 8.
Article 6 – Delivery
– Products are delivered to the address provided, within the timeframe indicated at checkout and, in any event, within 30 days of the order confirmation, unless otherwise agreed. If this period is exceeded, the customer may cancel the order and obtain a full refund.
– For bulky furniture, specific arrangements with specialised carriers are agreed with the customer.
– International shipping: for deliveries outside the European Union, any customs duties, import taxes and clearance fees are borne by the customer.
– The risk of loss or damage passes to the customer upon delivery.
Article 7 – Right of withdrawal
– Consumers have 14 days from receipt of the goods to withdraw, without giving any reason.
– To exercise it, the customer informs Fynd Vintage of the decision by an unambiguous statement (e.g. email to [contact email]) before the deadline. The model withdrawal form in the Annex may be used.
– Fynd Vintage refunds all payments received, excluding the standard (outbound) delivery costs, within 14 days of being informed, using the same means of payment. The refund may be withheld until the goods are received back or proof of return is provided.
– Return shipping costs are borne by the customer. For bulky items that cannot normally be returned by post, the estimated cost of return is up to approximately [€ …] depending on destination.
– The customer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning (as would be permitted in a shop).
– Exceptions: the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised (e.g. bespoke sourcing or custom restoration).
Article 8 – Legal guarantee
– Consumers benefit from the legal guarantee of conformity. For second-hand goods, the parties agree that the duration of this guarantee is [1 year / 2 years] from delivery, in accordance with Belgian law.
– The legal guarantee against hidden defects under the Civil Code also applies.
– Fynd Vintage is not liable for misuse, negligence or normal wear related to the age of the item, nor in respect of the characteristics described in Article 5.
Article 9 – Data protection (GDPR)
– Fynd Vintage processes personal data (name, address, email, order data) to manage orders, deliveries, invoicing and customer service, on the legal bases of contract performance and legal obligations.
– Data may be shared with service providers strictly for these purposes (payment: Stripe, PayPal; carriers; hosting: Odoo).
– Under the GDPR, the customer has the right to access, rectify, erase, restrict, port and object. Requests: [contact email].
– The customer may lodge a complaint with the Belgian Data Protection Authority (www.dataprotectionauthority.be).

Article 10 – Dispute resolution
– Before any legal action, the customer may contact us at [contact email] to seek an amicable solution.
– As a consumer, you may also refer the matter to the Belgian Consumer Mediation Service (Boulevard du Roi Albert II 8 Bte 1, 1000 Brussels; www.consumerombudsman.be).
Article 11 – Intellectual property
All content on the website (texts, photographs, logo, the "Fynd Vintage" name) is protected and remains the property of Fynd Vintage. Any reproduction without prior written consent is prohibited.
Article 12 – Force majeure
Fynd Vintage is not liable for any failure or delay caused by events beyond its reasonable control (natural disaster, strike, carrier failure, disruption of supply).
Article 13 – Governing law and jurisdiction
These Terms are governed by Belgian law. Mandatory consumer-protection provisions of the customer’s country of residence remain applicable. In case of dispute, the courts of the judicial district of Fynd Vintage’s registered office have jurisdiction, without prejudice to the consumer’s mandatory rights.
